The court on December 7 approved the foundation stone of the new Parliament House but prohibited any tampering with the existing structure until a decision was taken.<\/h2>\n

New Delhi:<\/strong> The Supreme Court on Tuesday cleared the Central Government’s landmark ‘Central Vista’ project. A bench of Justice<\/a> AM Khanwilkar, Justice Dinesh Maheshwari, and Justice Sanjeev Khanna ruled with a 2:1 majority that the green light given by the Ministry of Environment to the project does not suffer any irregularities.<\/p>\n

Justice Khanwilkar<\/a> and Justice Maheshwari also upheld the notification of a change in land used by the Delhi Development Authority, while Justice Khanna disagreed.<\/p>\n

Five petitions were filed against the project, including notification of land-use change through the Delhi Development Authority and for ignoring environmental concerns. The court reserved had its verdict on November 5 last year after a long hearing.<\/p>\n

Significantly, the court on December 7 approved the foundation stone of the new Parliament House but prohibited any tampering with the existing structure until a decision was taken.<\/p>\n

Solicitor\u00a0General Tushar Mehta apologizes<\/h3>\n

Justice Khanwilkar had expressed his displeasure at not proceeding with the disposal of the case and the construction work and told Solicitor General Tohar Mehta, “There is no restriction, it means we can move forward together. Facing the resentment of the bench while doing so, the Solicitor General had demanded a day from the government to take instructions, but the court had negotiated with the government to come back on the same day and adjourned the hearing for some time.<\/p>\n

Mehta, then, returned and apologized. The court assured that there would be no construction, sabotage, or felling of trees. The foundation stone would be laid, but there would be a change.<\/p>\n

Taking Mr. Mehta’s statement on record, Justice Khanwilkar ordered that the landmark program continues on December 10, but no further construction work would take place.<\/p>\n
